  1. Refund Policy:
    1. Damaged or Incorrect Products Received: If you receive a product which is different from the one on the website or that was damaged during shipment, you will receive full refund on purchase price and all the shipping costs. Products must be retuned unopened and in resalable condition. Please do not discard any damaged products.
    2. Product Caused Side Effects: A product that caused unwanted side-effects after use can be returned if it is returned within 5 days of your receipt of the product.
    3. Live Body Coach reviews the case and claims are found to be accurate Live Body Coach will issue a refund as they see fit.
  2. Return Procedure:
    1. You shall first email us at support@livebodycoach.com to obtain a RMA (Return Merchandise Authorization) number which we will issue to you after you have notified us that you received damaged product, the incorrect product, received an unwanted side effect or Live Body Coach reviewed the case and claims were found to be accurate.
  3. Privacy
    4. To fully understand the conditions and business practices of LIVE BODY COACH LLC and your guidelines to conduct business with us, please review our Privacy Notice.

You should not infer that LIVEBODYCOACH.COM endorses any of these suggestions, and you should use all the information in these chat rooms at your own risk. Information that is shared in these chat rooms is for informational and educational purposes only. It is not intended as medical advice, and should not be used as a substitute for a visit to your doctor or other medical professional
    2. Messages that you post in any of our chat rooms are not private.
    3. LIVEBODYCOACH.COM will monitor the chat rooms from time to time to ensure that no offensive or inappropriate language is used. LIVEBODYCOACH.COM will delete postings that are offensive and will revoke membership privileges of users that continue to use offensive or abusive language. LIVEBODYCOACH.COM cannot guarantee that such messages won't appear and LIVEBODYCOACH.COM cannot resolve disputes between users.
  12. Monthly Membership Autopay.
    13. You hereby authorize LIVE BODY COACH LLC to enroll me in the _______ membership program. I understand the terms and conditions described below. I understand that this charge is a monthly recurring charge to be a member of LIVEBODYCOACH.COM's __________ membership program. I authorize and instruct LIVE BODY COACH LLC to charge the amount of my monthly membership fee to my designated credit card/charge card or bank/checking account. The amount to be charged, set forth on my invoice, shall be sent by LIVE BODY COACH LLC to the credit or check card company or bank, which I identify, on the due date listed on the invoice. I understand my payment amount may change because of changes in fees. I understand that if my payment due date is on a weekend or holiday, my account will be charged on the preceding business day. I understand and agree that LIVE BODY COACH LLC is not liable in any way for erroneous charges to my credit card accounts and/or debits to my checking account, and that should an error in the bill occur, LIVE BODY COACH LLC's sole responsibility is to correct it, when and if it receives written notice of the error, with proper documentation, from me. I understand my financial institution and LIVE BODY COACH LLC reserve the right, upon written notification to me, to terminate this payment option and/or my participation in the __________ membership program and/or the AutoPay Program. My participation is subject to the approval of LIVE BODY COACH LLC and of the participating financial institution. I am responsible for any charges imposed by my bank or credit card Company for exceeding my account limits or overdrawing my account. I understand that I need to send written notification of my cancellation to Live Body Coach LLC to the following address:

  13. Warranty
    14. All products purchased from LIVEBODYCOACH.COM's website are manufactured by third party manufacturers and will be subject to the warranty provided by the third party manufacturer.

    You should if applicable register your product with the manufacturer and call the manufacturer directly to deal with any manufacturing warranty issue.

    LIVE BODY COACH LLC may sell extended warranties on certain products that are sold on our website. If you purchase and extended warranty, you should call the Toll Free number listed on the extended warranty to handle any warranty issue that may arise.

    LIVE BODY COACH LLC makes no other express or implied warranty or condition whatsoever, whether written or oral. To the extent allowed by the local law of jurisdiction outside of the U.S., LIVE BODY COACH LLC disclaims all implied warranties of merchant ability and fitness for a particular purpose. For all transactions occurring in the U.S., any implied warranty of condition of merchant ability, satisfactory quality, or fitness for a particular purpose is limited to the duration of the express warranty set forth above. Some states or countries/regions do not allow a limitation on how long an implied warranty lasts or the exclusion or limitation of incident or consequential damages for consumer products.     15. All items purchased from LIVEBODYCOACH.COM or from the LIVEBODYCOACH.COM offices or sales/distribution agents are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon delivery to the carrier.

  16. Pricing
    17. Except where noted otherwise, the prices displayed for LIVE BODY COACH LLC products represent the full suggested retail price listed on the product itself. Where an item is offered for sale by one of our merchants, independent sales representative or distribution agents, the price may be provided by that merchant.

    With respect to items sold by LIVEBODYCOACH.COM, we cannot confirm the price of an item until you register online and complete an online order form; however, we do NOT charge your credit card until after your order has entered the shipping process.

    Please note that this policy applies only to LIVE BODY COACH LLC products sold on LIVEBODYCOACH.COM and shipped by LIVE BODY COACH LLC or its affiliate. If a third-party site quotes prices different from the LIVEBODYCOACH.COM, your only remedy is to contact the third-party site to settle any dispute.

      2. ANY CHANGES WHICH LIVE BODY COACH MAY MAKE TO THE SERVICES, OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE SERVICES (OR ANY FEATURES WITHIN THE ERVICES);
      3. THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE, ANY CONTENT AND OTHER COMMUNICATIONS DATA MAINTAINED OR TRANSMITTED BY OR THROUGH YOUR USE OF THE SERVICES;
      4. YOUR FAILURE TO PROVIDE LIVE BODY COACH WITH ACCURATE ACCOUNT INFORMATION;
      5. YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL;
      THE LIMITATIONS ON LIVE BODY COACH'S LIABILITY TO YOU SHALL APPLY WHETHER OR NOT LIVE BODY COACH HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

      Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.

  18. Credit Card Charge backs
    19. Subscription or Membership cancellations must be received "before" the next billing cycle renewal date to avoid the automatic non-refundable renewal fee for said service. Payment for the services provided to you at and/or through this site may be made by automatic credit card, check or bank debit or through any other facility available during the registration process, and you hereby authorize the firm and/or its authorized agent (the "agent"), which is currently PayPal, Inc. and Authorize.net, to transact such payments on your behalf by charging your credit card (or other approved facility) for the subscription fees according to the billing terms for membership posted on these Terms and Conditions of Use at the time of payment. Subscription fees are earned upon receipt and are non-refundable regardless of how long the user remains a member. The user agrees to be personally liable for all charges incurred by the user during or through the use of the site. The user's liability for such charges shall continue after termination of the user's membership for any reason.
  19. Shipping on Credit Card Purchases and Returns
    20. In order to protect LIVEBODYCOACH.COM members from fraudulent use of their membership account or credit card, LIVEBODYCOACH.COM's and its vendors will only ship products purchased under your account to your address listed under your account. LIVEBODYCOACH.COM has adopted this policy to protect its members from a third party gaining access to your account and ordering product for themselves and having it billed to your account.
  20. Waiver; Time within Which Claims Must Be Brought

No waiver of any provision of these terms of use by us shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these terms of use shall not constitute a waiver of such right or provision. YOU AGREE THAT ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OF USE, THIS OR ANY OTHER SITES MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE DISPUTE, CLAIM OR CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH DISPUTE, CLAIM OR CAUSE OF ACTION SHALL BE PERMANENTLY BARRED.
  21. Applicable Law

By visiting LIVEBODYCOACH.COM, you agree that the laws of the State of Arizona, USA, without regard to principles of conflict of laws, will govern these Terms and Conditions of Use and any dispute of any sort that might arise between you and LIVEBODYCOACH.COM or its affiliates. In addition, we control and operate the Site from our offices in the United States of America. We do not represent that Site content is appropriate or available for use in other locations. Persons who chose to access the Site from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable.

    23. If any provision of these Site Terms shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions of Use and shall not affect the rest of the Terms and Conditions of Use.
  23. Disputes
    24. Any dispute relating in any way to your visit to LIVEBODYCOACH.COM or to products you purchase through LIVEBODYCOACH.COM shall be submitted to confidential arbitration in Phoenix, Arizona, except that, to the extent you have in any manner violated or threatened to violate LIVE BODY COACH LLC's intellectual property rights, LIVE BODY COACH LLC may seek injunctive or other appropriate relief in any state or federal court in the State of Arizona, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise. This clause applies to any charge back request you make to your credit card issuer.
  24. * Fee's Policy

    25. Livebodycoach.com Membership With 30-Day Trial: You will be asked for a valid credit card when you sign up for the 30-Day Trial. Live Body Coach will verify your credit card information before processing your order. Live Body Coach will not bill you the monthly membership price of $19.95 until the 30-Day trial period is over. If you do not cancel your 30-Day trial membership within 30-Days of the day you place your order, your membership will continue automatically and the monthly fee will be billed to the credit card or other billing source provided by you when you enrolled in the 30-Days program on the first day of each successive membership term.

  25. Live Body Coach, Body Bucks
    26. Live Body Coach reserves the right to modify these Terms and Conditions from time to time in its sole discretion, without notice or liability to you. You agree to be bound by these Terms and Conditions, as modified. Please review the most current version of the Terms and Conditions from time to time, so that you will be apprised of any changes.

    Charges and payment terms may be changed in accordance with the applicable price schedule; all other provisions may be changed by the Site immediately. Your access to the Body Bucks may be terminated immediately upon notice to the provider of the Body Bucks Services if any change is unacceptable. Continued use of the Body Bucks Services following any change constitutes acceptance of such change.

    Live Body Coach may terminate your access to the Body Bucks Services. The effective date of termination shall be twenty four (24) hours after the receipt of an appropriate notice of termination, unless a later date is specified in the notice. Live BodyCoach may suspend or discontinue providing the Body Bucks Services to you without notice and pursue any other remedy legally available to the Site if you fail to comply with any of your obligations hereunder.

    You are limited to spending your Body Bucks on one item per billing cycle. All purchases do not include shipping and handling. Body Bucks store items fall under the same standard refund and return policy of Live Body Coach.
